At the Law Office of Brian C. Perlin, P.A., I work closely with other professional advisors, including Certified Financial Planner™ Practitioners, investment advisors, financial consultants, insurance professionals, Certified Public Accountants, and other tax advisors. I believe that a team approach can provide clients with a more effective estate plan.

My Approach

I ask clients to fill out a short questionnaire prior to our initial consultation. This not only facilitates a more productive first meeting, but it also helps clients to focus on the issues and decisions they must make in order to implement the most effective planning strategies.

At our initial consultation, I provide clients with general recommendations and a fee quote for the services I will be providing, along with a retainer agreement.

During the implementation phase, I continually communicate with my clients. I firmly believe that communication is an essential element both of proper planning and of building lasting relationships.

Clients should only execute a document if they fully understand its content; to that end, I dedicate a significant amount of time to the execution of documents with clients. I thoroughly explain each element of any plan I develop with the client, and answer any questions that come up in the process.

Through my seminar programs and annual client appreciation events, I keep clients informed of recent developments in estate planning, and remind them to constantly monitor their plans.

Every professional organization has different processes for interacting with clients. I can work within your processes, or will work with you to blend our respective methodologies. My primary goal is to serve the needs of clients, and I welcome the opportunity to serve them within a team environment.

Probate is one manner in which estate assets are transferred after death. Since probate can be a lengthy, costly and public process, many people choose to avoid it. Without proper probate avoidance planning, the state will require a probate court proceeding for state residents or those who owned assets in the state. During probate, assets are managed, debts are paid, tax returns are filed along with various court documents, and the estate assets are distributed.

In the absence of any planning to the contrary, your estate will be distributed according to Florida's laws of intestacy. This so-called "default" estate plan might not reflect your wishes. However, if you do plan in advance, you can have your estate administered according to your preferences. A comprehensive estate plan may include a Last Will and Testament, Trusts, Powers of Attorney, Advance Directives and Health Care Documents, all supporting your legal, personal, investment and tax planning purposes.

As our population ages, more and more people will confront elder law-related issues. Elder law is an aspect of estate planning that focuses primarily on the changing needs of people as they age. Careful planning can help you avoid spending down your assets on long-term care. Issues include senior housing and home care, long-term care, or nursing home care, guardianships, health care documents, Medicare planning, and Medicaid planning.
